This License Agreement ("Agreement") is made and entered into between TurboStart, represented by Jan Poth, whose contact information is [email protected], and you, the user ("Licensee"), concerning the utilization of the TurboStart coding boilerplate (the "Product") accessible at https://turbost.art (the "Website"). By downloading, accessing, or utilizing the Product, Licensee agrees to abide by the terms and conditions outlined in this Agreement.

1. Grant of License

1.1 Personal License

Subject to the stipulations of this Agreement, TurboStart grants Licensee a non-exclusive, non-transferable, and non-sublicensable Personal License for the use of the TurboStart coding boilerplate for the following purposes:

• Create an unlimited number of projects.
• Develop and construct applications or websites for personal or commercial use.

1.2 Team License

Subject to the provisions of this Agreement, TurboStart grants Licensee a non-exclusive, non-transferable, and non-sublicensable Team License for the use of the TurboStart coding boilerplate for the following purposes:

• Create an unlimited number of projects.
• Develop and construct applications or websites as part of a team.
• Share the code with other members of the team.

2. Restrictions

Licensee shall refrain from:

• Modifying, adapting, reverse engineering, decompiling, disassembling, or creating derivative works based on the TurboStart boilerplate.
• Removing, altering, or obscuring any copyright, trademark, or other proprietary notices from the TurboStart boilerplate.
• Utilizing the TurboStart boilerplate in any manner that violates applicable laws, regulations, or third-party rights.
• Sub-licensing, renting, leasing, or transferring the TurboStart boilerplate or any rights granted under this Agreement.

3. Ownership and Intellectual Property

TurboStart retains all ownership and intellectual property rights pertaining to the TurboStart boilerplate. This Agreement does not confer upon Licensee any ownership rights in the TurboStart boilerplate.

4. Warranty and Disclaimer

THE TURBOSTART BOILERPLATE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TURBOSTART SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE TURBOSTART BOILERPLATE, EVEN IF TURBOSTART HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Germany, excluding its conflicts of law principles. Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Germany.

7. Entire Agreement

This Agreement constitutes the entire agreement between Licensee and TurboStart concerning the subject matter herein and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings.
